In a previous blog Share Options – good for employers and employees I set out some of the benefits that share schemes offer both employers and employees.

 

EMI Schemes

The scheme that is specifically aimed at smaller companies is the Enterprise Management Incentive Scheme (EMI). As the scheme offers tax advantages it is necessary under European law to have approval from the European Commission under the EU State Aid rules.

Unfortunately, the permission expired on 6 April 2018 and it appears that the UK did not request an extension of the approval until March 2018. EU State Aid approval was granted on 15 May 2018.

Therefore, companies can now proceed to grant new options under existing schemes or set up new schemes, confident that the tax advantages will apply.
