Companies
Members Voluntary Liquidation
This is a formal process for solvent companies and can be used to secure an orderly winding down, a restructure or for tax planning. We are able to act and assist the directors and shareholders.
Court Liquidation
This is a formal process for insolvent companies and is often a solution used by creditors. It is also used by directors if a company is insolvent. We can assist creditors or directors with this from the outset and can act as liquidator.
Creditors Voluntary Liquidation
This is appropriate if a company is insolvent, and is often used by companies. We can assist directors and shareholders to ensure appropriate steps are taken and can act as liquidator if required.
Administration
This legal insolvency process can be used as a solution by creditors and can also be used to prevent creditor action against a company. It enables the administrator to formulate proposals which are then subject to the approval of the creditors. We can assist directors, shareholders or creditors to initiate this process and act as administrator if required. The purpose of administration is usually achieved within 12-months of appointment.
Receivership
This is usually used by banks or by any creditor who holds a floating charge created before 15 September 2003. The receiver primarily acts for this creditor.
Individuals / Partnerships
Sequestration
We are able to take appointments in cases where individuals or partnerships, with assets, or surplus income, are seeking their own sequestration or where creditors require the appointment of a Trustee. The debtor will normally receive an automatic discharge after one year.
Protected Trust Deed (PTD)
A PTD involves the appointment of a Trustee, it is a legally binding agreement with creditors and only available to debtors residing in Scotland. It usually lasts for three years and is available to individuals, or partnerships, who have surplus income or assets. We can be appointed to act as Trustee.
